DUI License Suspensions in Massachusetts
In Massachusetts your license will be suspended if your are convicted of DUI, fail a breathalyzer or blood test or refuse to take a breathalyzer test. The length of the suspension depends on several factors. The number of prior convictions, your decision to take the test or to refuse the test and the reading of the test all factor into the length of the suspension.
- Taking and failing the breathalyzer test
- The legal limit in Massachusetts is a .08
- If you blow a .08 or greater there is a 30 day loss of license
- This suspension terminates after a guilty plea, trial or a dismissal
- Refusing the breathalyzer test
- With no prior convictions - - 180 days
- If you have 1 prior conviction or are under the age of 21 - - 3 years
- If you have 2 prior convictions - - 5 years
- If you have 3 prior convictions - - Lifetime
- If you have a prior conviction with serious bodily injury - - 10 years
- If you have been convicted of motor vehicle homicide or manslaughter - - Lifetime
